Terms of Service

1. Acceptance of Terms

By accessing or using the Balaji Builds website (balajibuilds.com) — whether as a visitor, client, engineer, or property lister — you agree to be legally bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms in full, you must stop using the platform immediately. We reserve the right to update these terms at any time. Continued use after an update constitutes acceptance of the revised terms.

2. What Balaji Builds Is (and Is Not)

Balaji Builds is operated by Balaji Constructions, a registered micro enterprise based at Gurmatkal, Yadgir District, Karnataka, India. What we provide falls into three parts.

2a. The marketplace — free

We provide a connection platform: a directory of construction professionals, listings for property and building materials, and a board where clients post project requirements. It helps parties find each other and deal directly.

• We are not a real estate broker, building contractor, or employment agency. We do not execute construction projects, run sites, or supervise work in person. (Section 2c covers the design and documentation work we do provide.)
• We do not act as a party to any contract between a client and an engineer, or between a property buyer and seller.
• We do not charge brokerage fees, transaction commissions, or any fee for making a connection.
• We do not collect, hold, route or settle payments between users. Money owed between two users is paid directly between them, outside this platform.
• We do not guarantee the quality of work performed by any professional, the accuracy of any listing, or the outcome of any transaction.

Any agreement entered into between users of this platform is solely between those users. Balaji Builds is not a party to such agreements.

2b. Our software products

We also build and provide our own applications, which you may use with a registered account:

• Balaji Workspace — construction project-management software for running your own sites. Governed by Section 12.
• Balaji Invoice — invoicing and payment-tracking software for small businesses. Governed by Section 13.

These are licensed to you as software services. The Balaji Workspace project fee is described in Section 14.

2c. Design and documentation services — paid

Separately from the marketplace, we provide certain professional services ourselves, prepared by our own engineers and delivered to you electronically. These include architectural floor plans, elevations, structural design, working and construction drawings, electrical and plumbing layouts, site and layout plans, building estimates, bills of quantities, floor plans for mutation, vastu consultation plans, renovation drawings, 3D renders and walkthroughs, and the preparation of building-permission drawing sets.

• Delivered remotely. These services are performed off site and delivered to you digitally. They are available anywhere in India.
• We may assign the work. Where a job falls outside what we can prepare in house — because of specialisation, local code knowledge or capacity — we may assign it to a listed professional from our network to carry out on our behalf. This does not change your position. Your agreement remains with Balaji Constructions, the fee you accepted does not change, and we remain responsible to you for delivery, for the quality of the output and for revisions, exactly as if we had drafted it ourselves. Anyone we assign work to is bound to keep what you give us confidential and to use it only for your job. We will tell you if your work is being assigned.
• Priced per project. Fees vary with scope and are not published as a fixed rate. We provide a written quotation, including the delivery timeline, before any work begins. Requesting a quotation is free and carries no obligation.
• You approve before we start. No fee becomes payable until you have accepted a quotation for a defined scope.
• What this is not. Providing a drawing, design, estimate or document does not make us the contractor for your project, and does not make us responsible for how the work is executed on site, by whom, or to what standard.
• Statutory approvals. Where a service involves an application to a municipal body, panchayat or other authority, we prepare the drawings and documents. We do not control, and cannot guarantee, whether or when that authority grants approval.
• Accuracy of what you give us. Our output depends on the plot dimensions, survey details, site conditions and requirements you supply. We are not liable for defects arising from inaccurate or incomplete information provided by you.

Cancellations and refunds for these services are governed by our Refund & Cancellation Policy.

2d. Work we do not undertake

We do not carry out the physical execution of construction, and we do not provide services that require our personnel to attend your site — including site supervision, soil testing, physical inspections, and appearing before an authority in person. Where you need any of these, we may refer you to a professional listed in our network. Such a referral is free, we receive no commission or fee for it from you or from them, and the resulting engagement is governed by Section 2a: it is a contract solely between you and that professional, to which Balaji Builds is not a party.

2e. Referral and assignment are not the same thing

Two different situations both involve a professional from our network, and it matters which one you are in:

• A referral (Section 2d) — you have not paid us for the work. We introduce you, you agree terms and price directly with that professional and pay them directly. We take nothing from either side and are not a party to your agreement. If something goes wrong, your claim is against that professional.
• An assignment (Section 2c) — you have paid us for a service under an accepted quotation, and we have chosen to have a network professional prepare it. You have no agreement with them at all. Your agreement is with us, your payment is to us, and we are answerable to you for the result. If something goes wrong, your claim is against Balaji Constructions.

In short: if you paid us, we are responsible, whoever does the drafting. If we merely introduced you, we are not.

3. Engineer Registration

3a. Eligibility

You may register as a professional on our platform if you are a civil engineer, structural engineer, architect, interior designer, contractor, or related construction professional. You must be at least 18 years of age.

3b. Accuracy of Information

You agree to provide accurate, complete, and current information in your registration. This includes your name, contact details, specialisation, location, and years of experience. Providing false or misleading information is a serious violation of these terms and will result in immediate and permanent removal from the platform.

3c. Document Uploads (Optional)

You may optionally upload supporting documents such as a degree certificate, government or national ID, professional licence, or project portfolio. Uploading documents is entirely voluntary. If you choose to upload documents, you confirm:

• The documents are genuine and unaltered.
• The documents belong to you personally.
• You consent to our admin team reviewing them as part of the profile review. Note that we read documents for plausibility only — we do not authenticate them with the issuing body.

Uploading fraudulent, forged, or doctored documents is a serious violation and may be reported to relevant authorities.

3d. Profile Approval

All registrations are subject to manual review by our admin team. We reserve the right to approve, reject, or remove any profile at our sole discretion, including profiles that contain inaccurate, incomplete, or inappropriate information. Approval typically takes 2–3 business days. You will be notified once your profile is reviewed.

3e. Profile Responsibility

You are responsible for keeping your profile information up to date. If your qualifications, location, or availability change materially, please update your profile or contact us to have it updated or removed.

4. Client Enquiries

To contact an engineer via the platform, clients must submit basic project details (name, phone, email, project type, and budget). By submitting an enquiry you confirm:

• You are a genuine prospective client with a real project or need.
• The information you provide is accurate.
• You will not use engineer contact details for spam, solicitation, or any purpose unrelated to your stated project.

We enforce a daily limit on the number of engineer contacts a single client account can reveal. This limit exists to protect the privacy of professionals on our platform. Circumventing this limit through multiple accounts, automated tools, or any other means is strictly prohibited and will result in a permanent ban.

5. Property Listings

Property listings on Balaji Builds are submitted directly by property owners. By listing a property you confirm:

• You are the legal owner of the property or are authorised to list it on the owner's behalf.
• All details — including address, property type, dimensions, and asking price — are accurate to the best of your knowledge.
• The property is legitimately available for sale and free of undisclosed legal encumbrances.
• You will not list the same property multiple times or use the platform to defraud prospective buyers.

We reserve the right to remove any listing that appears suspicious, fraudulent, or in violation of these terms without prior notice.

6. Prohibited Conduct

You must not use the Balaji Builds platform to:

• Submit false, misleading, or fraudulent information of any kind.
• Harass, threaten, or abuse other users.
• Scrape, harvest, or systematically collect user data, contact details, or listings using automated tools.
• Circumvent contact limits, spam filters, or any other protective mechanism.
• Impersonate another person, engineer, or entity.
• Use the platform for any purpose that is illegal under applicable local, national, or international law.
• Attempt to gain unauthorised access to any part of the platform, its databases, or infrastructure.
• Post or transmit malware, phishing links, or any malicious content.

Violations may result in immediate suspension, permanent ban, and in serious cases, referral to law enforcement.

7. No Guarantee of Results

What our review is, and is not. No listing is published automatically. Before a profile or listing goes live, our admin team reads through the details submitted at registration and approves it only if it appears complete and genuine. That is the whole of it. We do not independently confirm any of it: we do not contact universities, licensing bodies, COA, tax authorities or past clients, we do not authenticate uploaded documents, and we run no background checks. A listing on Balaji Builds means the details were reviewed before publication — it is not a certification of anyone's qualifications, competence or honesty, and you should not treat it as one. Always ask a professional for their own documents and references before you engage them.

Accordingly, we cannot guarantee:

• The quality, timeliness, or outcome of any construction work performed by a listed engineer.
• The accuracy of self-reported engineer experience or specialisation.
• The legal title, market value, or condition of any listed property.
• That any connection made through the platform will result in a successful transaction or project.

You use the platform and make decisions at your own risk. We strongly recommend conducting your own due diligence before entering into any contract or financial commitment.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Balaji Builds, its founders, team members, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• Any loss of data, revenue, profit, or business opportunity, even if advised of the possibility of such loss.
• The conduct, actions, or omissions of any engineer, property lister, buyer, or other third party using the platform.
• Platform downtime, data loss, or technical failures.

In all cases, our total liability to you for any claim shall not exceed the total amount you have actually paid us in the 12 months preceding the claim. For users of the free marketplace that amount is zero; for Balaji Workspace customers it is limited to the project fees you have paid.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2019.

9. Intellectual Property

All content on the Balaji Builds website — including the logo, design, text, graphics, and code — is the property of Balaji Builds and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of this platform without our express written permission.

By uploading documents, photos, or any content to the platform, you grant Balaji Builds a non-exclusive, royalty-free licence to store and display that content solely for the purpose of operating the platform. You retain ownership of your content. We will remove it upon your request.

10. Account Suspension and Termination

We reserve the right to suspend or permanently remove any engineer profile, property listing, or user account at any time, with or without notice, for any of the following reasons:

• Violation of any part of these Terms of Service.
• Receipt of credible complaints from other users.
• Discovery of false or fraudulent information.
• Inactivity or outdated information that may mislead clients.
• Any other reason that, in our sole judgement, harms the integrity of the platform.

If your profile or account is removed, you may contact us at admin@balajibuilds.com to request a review of the decision.

11. Third-Party Links and Services

The platform may contain links to third-party websites (such as LinkedIn profiles, Google Maps, or WhatsApp). These links are provided for convenience only. Balaji Builds has no control over the content or privacy practices of third-party sites and accepts no responsibility for them. Visiting a third-party link is at your own risk.

12. Balaji Workspace

Balaji Workspace (balajibuilds.com/workspace) is our construction project-management software. Registered professionals use it to run their own construction sites — recording site logs, tasks, materials, labour attendance, expenses, payments, suppliers, quality checks, drawings and site photographs.

12a. Accounts and access

You sign in using the mobile number registered to your Balaji Builds profile. You are responsible for keeping access to that number and account secure, and for all activity that takes place under your account. Tell us immediately if you believe someone else has gained access.

12b. Your data belongs to you

The site records, photographs, financial entries and documents you enter into Workspace are yours. We store and process them only to provide the service to you. You can export your data at any time from within the application, and you can ask us to delete it — see our Privacy Policy.

12c. Team members

You may invite other people to a project as an owner, editor or viewer. By inviting someone you authorise them to see the data in that project at the level you grant, and you are responsible for choosing who you invite and for removing access when it is no longer needed.

12d. Shared reports

When you generate a shareable report link, anyone holding that link can view the information it contains, without signing in. Share such links only with people you intend to have that information.

12e. Accuracy and reliance

Workspace is a record-keeping and calculation tool. The figures it produces — including wage calculations, expense totals and project summaries — depend entirely on what you enter. We do not verify your entries and we are not responsible for decisions you take based on them. Keep your own backups of anything business-critical.

12f. Availability

We aim to keep the service running continuously but we do not guarantee uninterrupted availability. We may need to suspend access for maintenance, upgrades or reasons outside our control.

13. Balaji Invoice

Balaji Invoice (balajibuilds.com/invoice) lets you create invoices, manage clients and products, and track payments received and outstanding. It is currently provided free of charge.

• You are responsible for the accuracy of everything on an invoice you issue — amounts, GSTIN, HSN codes, tax rates and client details.
• We are not tax advisors. The tax calculations the software performs are a convenience, not professional advice. You remain responsible for complying with GST law and for filing your own returns. Check with a qualified accountant if you are unsure.
• Invoices you create are your business records. We store them so you can access them, and you can export them at any time.
• You must not use the software to issue false, fraudulent or misleading invoices.

14. Fees, Payment and Refunds

Almost everything on Balaji Builds is free. The one exception is set out here. Full details are on our Pricing page.

14a. What we charge for

In Balaji Workspace, your first 3 projects are free. To create any project beyond that, you pay a one-time fee of ₹99 per additional project. This is a licence fee paid by you, directly to Balaji Constructions, to unlock a feature of our own software. It is not a payment to or on behalf of any other user.

14b. How the fee works

• It is a one-time charge, not a subscription. There is no recurring billing, no auto-debit and no stored payment mandate.
• A project you have paid for is never charged again.
• The price shown includes any applicable taxes.
• All prices are in Indian Rupees. We currently serve customers in India only.

14c. Payment processing

Payments are processed by a licensed third-party payment gateway. Your card, UPI or banking credentials are entered on the gateway's secure interface and are never seen or stored by us. Your use of the gateway is also subject to that provider's own terms.

14d. Refunds

Refunds are governed by our Refund & Cancellation Policy, which forms part of these terms. In short: failed, duplicate or non-delivered payments are refunded in full, and change-of-mind requests are honoured within 7 days where the project has not been meaningfully used.

14e. Price changes

We may change our prices in future. A change applies only to purchases made after the new price is published, and never retroactively to a project you have already paid for or a free project you have already created.

15. Reviews and User-Submitted Content

We publish reviews and ratings submitted by users. If you submit one:

• It must reflect your genuine, first-hand experience.
• You must not post a review in exchange for payment or other benefit, or write about your own business or a competitor's.
• It must not be defamatory, abusive, obscene, or contain another person's private information.
• We may decline to publish, edit for length, or remove any review — including one that appears fake, incentivised or malicious — and we may remove reviews at the subject's request where they breach these rules.

Reviews express the opinions of the people who wrote them, not of Balaji Builds. Publishing a review is not an endorsement, and we do not independently verify the events described in one.

16. Project Requirements and Material Listings

Clients may post project requirements, and suppliers may list building materials. By posting either:

• You confirm the requirement or listing is genuine and the details are accurate.
• You accept that approved requirements are shown to relevant registered professionals, who may contact you about them, and that approved listings are publicly visible.
• You must not use these features to advertise unrelated products, harvest contact details, or solicit users for anything other than the stated purpose.

We review submissions before publication and may reject or remove any of them at our discretion.

17. Messages and Notifications

When you register or submit information through our website or one of our WhatsApp registration bots, you agree that we may contact you on the phone number and email address you provide, for the following purposes:

• Confirming and processing your registration, enquiry or listing.
• Notifying you of activity relevant to you — for example a matching client requirement, or an update to your profile's approval status.
• Service messages about your account, including payment confirmations.
• Browser or app push notifications, if you have switched them on. You can turn these off at any time in your Workspace settings or your device settings.

You can ask us to stop sending non-essential messages at any time by replying to any message or emailing admin@balajibuilds.com. We will still send messages that are necessary to operate your account.

18. Governing Law

These Terms of Service are governed by the laws of India. Any dispute arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Yadgir District, Karnataka, India — unless applicable consumer protection laws in your country of residence require otherwise.
